Terms & Conditions

I. Scope

The use of the services offered by ahtida Clinic GmbH (hereinafter “operator”, “we”, “us”, “our”) on the AHTIDA platform (www.ahtidahealth.com ) (hereinafter: “platform”) by the user (hereinafter also “you”, “your”) is subject to the following General Terms and Conditions (hereinafter “Terms and Conditions”).

The platform is aimed at users from Switzerland and was developed according to the principles of Swiss law. The use of the platform and the services offered on it are limited to Swiss territory unless explicitly stated otherwise.

Our platform enables patients to book appointments with doctors specializing in mental health, urology/sexual health, dermatology and weight management treatments, use online services from doctors (telemedicine), and communicate with pharmacies and redeem prescriptions.

Before using the platform, you are required to create a user account and accept these Terms and Conditions as well as our privacy policy, which forms an integral part of the Terms and Conditions. By setting up a user account and accessing the platform, the user declares that they have understood and acknowledge these conditions and legal information. If you do not agree with these conditions, you should refrain from using the platform and the services offered on it.

Contrary or deviating conditions of the users do not apply, even if the operator does not separately object to their validity in individual cases. The operator’s Terms and Conditions also apply if services in connection with the platform (e.g., telemedicine services by our partner doctors) are provided without reservation with knowledge of contrary or deviating conditions. Individual written agreements made with users in individual cases nevertheless always take precedence over the Terms and Conditions.

 

II. Service Offering

Currently, the following services are offered through our platform:

1. Telemedicine and other medical services

The operator provides a telemedicine service on the platform for the treatment of patients with mental health, urology/sexual health, dermatology and weight management concerns. Through the platform, users can contact appropriately specialized medical practices or doctors who are either operated directly by the operator or with whom the operator cooperates based on a written contract and who offer their services via the platform.

Users can arrange an appointment on-site at the medical practice or with the doctor of their choice, or book an online consultation or treatment appointment (telemedicine). Online appointments are conducted via remote treatment/video consultation. The corresponding infrastructure (software, etc.) is provided by the operator via the platform.

If the user wishes to use a medical service and books a corresponding appointment for the first time, a questionnaire will be automatically sent to the user via the platform to fill out. This questionnaire was developed by the operator in cooperation with collaborating doctors and is evaluated by the operator in cooperation with them. The questionnaire must be completed online by the user before the first medical appointment (which usually takes place physically in a medical practice, unless the evaluation of the questionnaire by the partner doctor would show that the first appointment can also be conducted via video consultation) and is transmitted via the platform to the selected doctor or the corresponding medical practice. The aim of the questionnaire is to make an initial evaluation regarding the patient’s suitability for and experience with the use of the corresponding therapy. Users are obligated to fill out the questionnaire truthfully.

The consultation and treatment services on-site and via telemedicine are provided by qualified doctors with whom the operator cooperates. The operator only acts as an intermediary and enables users to access the corresponding services. The medical treatment contract is concluded directly and exclusively between the treating doctor or the medical practice and the user. The operator has no influence on the treatment or other services provided by the doctor and cannot be held liable for them.

The treating doctor and the medical staff of the cooperating medical practice act freely and independently regarding the decision to be made as to whether the use of telemedicine services by the respective user is justifiable and appropriate in individual cases. The provision of specific medical services is furthermore carried out in compliance with labor, service, and professional obligations by the cooperating medical practices and doctors.

The mediation service owed by the operator extends to the provision of the infrastructure required for initiating medical services and establishing contact between the user and the medical staff of the medical practice (e.g., appointment booking) as well as the video consultation software required for conducting telemedicine services.

  1. Mail order of medications and other services provided by pharmacies

 The operator also mediates services from pharmacies on the platform. These services are provided by pharmacists and other qualified pharmacy staff with whom the operator has concluded a written cooperation agreement.

The cooperation with pharmacies enables platform users to redeem a prescription issued by the doctor following the video consultation directly via the platform. The operator only acts as an intermediary and enables the user to access the corresponding services. The operator has no influence on the consultation or other services provided by the pharmacy (e.g., redeeming and storing prescriptions, mail order of medications, etc.) and cannot be held liable for them.

The pharmacy and its staff provide their services freely and independently.

The mediation service owed by the operator extends to the provision of infrastructure for contacting the pharmacy and transmitting prescriptions to it via the platform.

  1. Booking appointments and other services

The platform enables users to book medical appointments online (physical or online) and attend these appointments via telemedicine video call (see above).

In addition, doctors can issue prescriptions and contact cooperating pharmacies via our platform to facilitate the rapid receipt of prescribed medications for the user.

We reserve the right to adjust the service offering at any time. To ensure that you as a platform user are always informed about adjustments to the service offering, we recommend that you sign up for our newsletter (see below).

III. Terms of Use

  1. Registration

Before our service offering can be used, the user must register on the platform and accept these Terms and Conditions, including the privacy policy.

Registration and use of the platform require the user to be of legal age, which must be confirmed by providing the date of birth when creating the user account.

Users can register here by providing their first name, last name, address, email address, and date of birth.

  1. User obligations

Technical access to the platform is solely the responsibility of the users. As a user, you are obligated to take the necessary security precautions for your own devices (e.g., computer, tablet, smartphone) from which you access the platform and protect them from unauthorized access by third parties and malware. You are also obligated to keep your user account data, especially the password, secret and not allow any third party to access the platform via your user account.

Users are hereby expressly advised of the security risks associated with the use of the Internet and Internet-based technologies. We as the platform operator strive to enable you to use the platform securely and protect it from unauthorized access. However, we cannot guarantee that the platform and corresponding services will always be available continuously and uninterrupted, nor that there is 100% security with Internet-based services such as those we provide.

Users are obligated to keep the platform or corresponding software (e.g., for video consultations) up to date and perform updates. There is no entitlement to use a specific version of the platform. Any costs for network access to use the platform and the services offered on it are borne by the user.

Each user is obligated to check the data they enter for completeness and accuracy. Users are responsible for all personal data entered and stored via the platform (see also our privacy policy).

As a user, you are also obligated to comply with the following rules of conduct:

  1. to answer the questionnaire sent with questions about health status truthfully and completely;
  2. to create appropriate conditions (brightness, quiet, technical requirements) for remote medical treatment/telemedicine consultation;
  3. not to distribute prohibited, defamatory, insulting, violence-glorifying, law-violating and/or pornographic content via the platform.

In case of violation of the mentioned obligations or in case of abuse, the operator reserves the right to immediately block the user’s access to the platform or the corresponding user account and not to provide any further services to the user. All other rights to which the operator is entitled under the contract or applicable law are expressly reserved.

IV. Data Protection and Release from Medical Confidentiality

Doctors, pharmacists and their assistants are subject to medical confidentiality. In order for us to provide you with the mentioned services, which include the mediation of telemedicine consultations, the transmission of the questionnaire about your health status, the billing or collection of medical services as well as appointment arrangements, it is necessary that you release the treating doctors, pharmacists and their assistants from the confidentiality obligation towards us to the extent necessary for us to provide services via our platform. The scope of this release as well as further information on the processing of your data by us is regulated in our privacy policy.

BY ACCEPTING OUR PRIVACY POLICY, WHICH FORMS AN INTEGRAL PART OF THESE TERMS AND CONDITIONS, YOU RELEASE YOUR TREATING DOCTORS, PHARMACISTS AND THEIR ASSISTANTS FROM MEDICAL CONFIDENTIALITY TOWARDS US TO THE EXTENT NECESSARY FOR THE PROVISION OF SERVICES BY US VIA THE PLATFORM.

We undertake to always treat your personal data and especially your health data with the utmost confidentiality and do not pass it on to third parties without your consent.

V. Payment for Services

1. Payment processing

    • Medical services
       i. Billing, collection and reimbursement

Medical services are billed by the medical practice or the treating doctor based on agreed flat rates or the tariffs applicable in Switzerland. Invoicing takes place immediately after a billable service has been performed. Payment is processed via the platform or by the operator as a collection service provider. For this purpose, the user must provide corresponding payment information (e.g., billing address, credit card) during registration.

Users are responsible for clarifying with their health insurance whether medical services are covered in whole or in part and for claiming reimbursement from their health insurance for paid services.

ii. No-show fee, cancellation and rebooking

Appointment bookings for medical services can be canceled or rebooked free of charge by the user up to 24 hours before the scheduled appointment. Cancellation/rebooking can be done directly via the appointment scheduler on the platform.

If an appointment is not canceled or is canceled or rebooked within less than 24 hours, the user will be charged a NO-SHOW FEE OF CHF 29.

b.Pharmacy services

Service billing and payment for medications is done directly through the pharmacy.

Users are responsible for clarifying with their health insurance whether these services or the costs of prescribed medications are covered in whole or in part and for claiming reimbursement from their health insurance.

c. Other services

 Other services (e.g., information and content provided on the platform, use of software for video consultations, online appointment booking, etc.) are provided to users free of charge.


VI. Copyright and Other Protective and Usage Rights

 All rights to the content published on the platform and the associated applications, in particular the copyrights, belong to the operator or the specifically named rights holders or have been licensed to the operator.

The content published on the platform may only be used by users for their own use. Any reproduction beyond this and passing on of content to third parties is prohibited. By downloading or copying content, images, photos or other files, no rights regarding the content are transferred.

VII. Newsletter

If you want to be informed at all times about our service offering, changes to the platform, our products and other developments, we recommend that you subscribe to our newsletter.

VIII. Liability

The operator’s liability for services provided by us is governed by the statutory provisions. Any liability claims against the operator for damages, including consequential damages of a material or immaterial nature, which have arisen, for example, from access to or use of the platform and its information, content and messages as well as services, through misuse of the connection, through technical disruptions or through violation of the user’s duty of care, are excluded to the extent legally permissible. In particular, any liability for indirect damages, especially consequential damages, incurred by users through the use of the platform or in the context of the provision of our services is excluded to the extent legally permissible. The liability exclusion does not apply to damages due to intent or gross negligence.

Liability for auxiliary persons and third parties is excluded to the extent legally permissible.

The operator assumes no responsibility and makes no guarantee that the functions and use of the platform are permanently and continuously available, error-free or trouble-free or that errors will be corrected or that the servers and software are free from viruses or other harmful components.

The operator is entitled at any time to interrupt or discontinue the use of the platform.

Although the operator takes all care to ensure the accuracy of the content and messages on the platform, no liability or warranty can be assumed regarding their content accuracy, precision, timeliness, reliability and completeness. The operator expressly reserves the right to change, delete or temporarily not publish information and content in whole or in part at any time without notice.

Any action or omission based on information, content or messages on the platform is the sole responsibility of the user and is at their own risk. The operator assumes no liability for resulting damages. Accordingly, the platform offers no recommendations for actions, omissions or behavioral instructions. The operator and the platform in particular do not make any medical assessments and do not recommend any treatment and/or taking certain measures.

References and links to third-party websites are outside the operator’s area of responsibility. The operator assumes no liability for the existence, content or accuracy of this information. Access to and use of such websites is at the user’s own risk. The operator expressly declares that it has no influence on the design, content and offers of the linked pages. Information and services from linked websites are entirely the responsibility of the respective third party. Any responsibility for such websites/links is rejected.

The operator is not liable for the provision of services by third parties, in particular for services provided by partner medical practices, partner doctors and partner pharmacies (including their staff) and their vicarious agents. Corresponding claims must be asserted directly against these third parties.

IX. Duration and Termination

 The use of the platform and the corresponding services is voluntary. Users can freely decide at any time to no longer use the platform and/or the corresponding services.

If termination with deletion of the user account is desired, this can be requested via email to support@ahtidahealth.com.  Please note that we will only delete your user account once all outstanding payments have been fully settled. In addition, we will continue to retain your data for archiving purposes until the expiry of the statutory periods (see also our privacy policy). If you would like an electronic copy of your data in advance, you can also request this by email to the above address. With the deletion of your user account, your right to use the platform, its content and the services offered on it ends.

The operator reserves the right to temporarily or permanently block or terminate the user account or the user’s access to the platform at any time and for any reason, including for non-compliance with these Terms and Conditions by the user or for performing maintenance work on the platform. The operator may decide at any time to discontinue the provision of the platform and the corresponding services. In such a case, users will be notified in advance and granted a refund for services already paid for but not used.

X. Final Provisions

The operator may change these Terms and Conditions at any time, in particular taking into account developments in law, legislation, case law and/or technology. The current version is the one available online at the following address: http//:ahtida.com/termsandconditions. The user is expressly advised that the only binding version of the Terms and Conditions is the one found online on the website, with which the user agrees unconditionally. By continuing to use the platform after such changes, the user agrees to the new Terms and Conditions. Important changes to the Terms and Conditions will be displayed to the user separately and 10 days before they come into effect.

Swiss law applies exclusively to all disputes arising from or in connection with a contract concluded on the basis of these Terms and Conditions. For all disputes arising from or in connection with these Terms and Conditions or the application, to the extent legally permissible, the courts at the operator’s registered office (currently: Zurich, Switzerland) have exclusive jurisdiction.
